Please read these terms of service carefully before using our service. They outline the rules and regulations for the use of Buzz Development's when ordering a service and product. Do not order a product or service if you do not agree with the terms and conditions outlined below.
The delivery of services will vary depending on the client requirements. Common delivery methods include uploading to GitHub, a ZIP file sent via email or other communication, or a direct link to the project.
Any agreed Deadline is merely a target and is not guaranteed. The Seller will inform the Client of any changes to the Deadline as soon as possible. Scenarios such as illness, family emergencies, vacations/holidays or any other further delays may affect the Deadline. Any known delays will be disclosed to the client as soon as possible.
Read below for information on payment terms and conditions.
The Seller reserves the right to withhold the delivery of services until payment is received. The Seller also reserves the right to withhold the delivery of services if the Client fails to provide the necessary information required to complete the service.
At no time will any payments made by the Client to the Seller be reversed, disputed formally or other wise "charged back". Any attempts to illegitimately/unfairly reverse payments for a Service or Product (a.k.a "friendly fraud") are taken extremely seriously by taking actions including but not limited to: contacting the Client's banking provider to formally address & report the matter and/or taking necessary legal action based on your jurisdiction. All evidence including communication logs, proof of delivery etc, will be provided to the relevant authorities/members of power to resolve the matter formally.
Any disputes with payments, Services or Products must first be handles via contacting the Seller. Please wait at least 7 days for a response before filing any formal disputes or complaints.

Failure to carry out a service provided by the Seller to the Client will result in a fair refund (Not including any work that has already been carried out by the Seller). If the amount of work carried out is less than an hour, the Client is eligible for a full refund.
Please refer to our refund policy to understand the conditions under which a refund may be issued.
Communication between the Seller and Client will be conducted via email, Discord, or other agreed upon methods. Communication can also include methods such as Google docs, PDF documents, task tracking software or other written content shared between the Client and the Seller. All communication will be professional and respectful. The Seller reserves the right to terminate the service with no refund if the Client is continually acting disrespectful, rude, or otherwise unprofessional.
All logs of communication is automatically stored and may be used as evidence in the event of a dispute.
The scope of work will be agreed upon by both parties before any work is started. The Seller reserves the right to refuse any work that is not within their skill set or is deemed inappropriate. The Seller also reserves the right to refuse any work that is deemed illegal or unethical without reason.
Preferably, the Client will provide the Seller with a detailed brief of the work required including the Deadline, budget, any relevant files/documents, and any other information that may be required. The Seller will then provide the Client with a quote for the work. The Client must agree to the quote before any work is started. The quote will include the price, Deadline and any other relevant information.
If a formal scope of work has been agreed on (via a document, PDF, message or other communication methods), the work carried out must be within the scope of work. Any additional work required that is not within the scope of work can be charged at an additional cost. After work has started, at no point can this document/agreement be modified in any way. The Seller holds zero responsibility for anything missed, forgotten about, or otherwise not made clear enough in the scope of work. The Seller will carry out only the work detailed in the scope of work.
If the scope of work has been agreed to change, the updated scope of work now becomes the active scope of work. At no time, can the Client update the scope of work, then change their mind about the changes/additions after the work on the changes has been carried out. Example: The Client updates the scope of work to add a new page for $40, the Seller completes the page, then the Client changes their mind about the page and refuses to pay for it.
The Seller will provide the client with free small changes and updates for an agreed amount of time (e.g. 1 week for smaller services, and up to 3 months for larger services). After this period, the Seller may charge for any changes or updates required. Any bug fixes will be carried out free of charge for as long as the Seller is still in business. The Seller reserves the right to refuse any changes or updates that are deemed inappropriate or unethical.

The time to carry out these changes can vary on the Seller's time constraints however will always be aimed to be completed quickly and in a timely manner. Changes requested inside the timeframe will still be completed even if the Seller fails to complete them inside the changes timeframe.
Until the Client has paid the Seller in full for the service provided, the Seller retains all rights to the intellectual property. Once the Client has paid the Seller in full, the Seller will transfer all rights to the intellectual property to the Client for any use. The Seller still reserves the right to use the intellectual property for their own use unless agreed otherwise by both parties, including but not limited to: showcasing the work in a portfolio or using the work for marketing purposes.
The Seller agrees to never sell, share or redistribute the intellectual property to any other party at any time unless agreed upon by the Client.
The Seller will always aim to provide the best service possible. However, the Seller cannot guarantee that the service provided will be error-free, timely, or meet the Client's requirements on the first draft/attempt. However, the Seller aims to rectify any issues as soon as possible to complete the product.
Sometimes, a feature or service may not be possible due to technical limitations or other reasons. The Seller will inform the Client of any limitations as soon as they are discovered. Examples of these technical limitations may include:
In some cases, especially when copying from a design or prototype, a service may not be developed 100% accurately based on the provided design, however, all efforts will be made to feasibly create a product that matches the provided design/prototype.
The Seller will not be liable for any direct, indirect, special, incidental, or consequential damages resulting from the use of the service or product. This includes but is not limited to: loss of revenue, loss of profit, loss of data, or any other damages.
The Seller will not be held responsible for any errors, bugs or warnings that may occur from the use of software, products, libraries or third-party effects on the Service. Examples may include: errors when hosting the website on the Client's host, an error/bug/malfunction due to a third-party library that the Client has added/installed on their own, changes the Client has made themself.
In some cases, where verbal/written informal or formal agreements are made between the Client and the Seller, these agreements are taken seriously and will be upheld. However, the Seller reserves the right to refuse any agreements that are deemed inappropriate or unethical. The Client does not have the right to reverse or otherwise go back on any agreements made between the Client and the Seller unless mutually agreed upon.
The following terms and condition apply to the referral system. Do not use the referral system or loyalty scheme if you do not agree to these terms.
Loyalty (points) schemePoints are not transferable
Points can not be turned into money
Points can not be earned on services or products that were purchased with points, or addons
Points expire after 6 months of no use
Quote minimum is $100 to be eligible
Referral value is capped at $1,000 per referral
Referral percentage can change at any time
Products purchased from the shop cannot be resold, redistributed, or shared without explicit permission from the Seller.
Products purchased from our shop must not be used for any illegal activities or purposes. The Client agrees to use the products in compliance with all applicable laws and regulations. Any use of our products for unlawful purposes is strictly prohibited and may result in immediate termination of services and potential legal action. The Seller reserves the right to report any suspected illegal activities to the appropriate authorities. Furthermore, the Client is solely responsible for ensuring that their use of our products does not infringe upon any third-party rights, including but not limited to intellectual property rights, privacy rights, or any other legal rights. The Seller shall not be held liable for any misuse or illegal application of the products by the Client or any third parties.
The Seller reserves the right to modify these terms of service at any time. Please refer to the top of this page to view the last updated date. If the Seller makes any changes to these terms of service, the Client will be notified via email or other communication methods. The Client is responsible for checking these terms of service regularly for any changes or updates.
